Scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
Contractual partner, conclusion of contract
The purchase contract is concluded with Alexander Buhler, Zum Schäferhof 10, 49088 Osnabrück. The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent. When the contract with us is concluded depends on the payment method you have chosen:
Klarna invoice
We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within two days.
Credit card
When you place your order, you also send us your credit card details and, after you have been legitimized as the legal cardholder, we request your credit card company to initiate the payment transaction and thereby accept your offer.
PayPal, PayPal Express
During the ordering process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.
Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This concludes the contract with us.
Contract language, contract text storage
The language available for the conclusion of the contract is German. We save the text of the contract and send you the order data and our GTC by e-mail. You can view the text of the contract on our website.
Terms of delivery / Shipping
Deliveries are only possible to delivery addresses within Germany, Austria and Switzerland. The order will be delivered exclusively by mail order.
Payment methods
The following payment methods are available in our store:
Credit card
When you place your order, you also send us your credit card details. Once you have been legitimized as the legitimate cardholder, we will ask your credit card company to initiate the payment transaction immediately after you have placed your order. The payment transaction will be carried out automatically by the credit card company and your card will be debited.
PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us. After placing the order in the store, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.
Sofort by klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
Purchase on account via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on account as a payment option. Please note that Klarna invoice is only available to consumers and that payment must be made to Klarna. When purchasing on account with Klarna, you always receive the goods first and you always have a payment period of 14 days. The goods remain our property until full payment has been received.
Transport Damage
If goods are delivered with obvious transport damage, please report such errors immediately to the delivery service and contact us without delay. Failure to report or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, it helps us assert our own claims against the carrier or transport insurance.
Warranty and Guarantees
The statutory warranty rights apply. For used goods: If a defect occurs more than one year after delivery of the goods, the warranty claims are excluded. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from the date of delivery of the goods.
Legal Right of Withdrawal
Information on the legal right of withdrawal can be found here. The legal right of withdrawal is mandatory for both parties. It applies primarily and from the delivery date for 14 working days.
Undeliverable Delivery
If, for reasons not attributable to us, your order cannot be delivered after several attempts, it will be returned to us. In this case, we assume that you want to withdraw from the contract, which then automatically converts into a repayment obligation relationship. As a consequence, we will promptly, but no later than 14 days after withdrawal, refund all payments received from you, excluding shipping costs (except for additional costs resulting from choosing a different shipping method than the one offered by us).
Discounts
Each discount code can only be used once per purchase and per customer.
Only one discount code can be used per order. The combination of different discount codes is not possible. The combination of bundles and discount codes is not possible.
When a discount code is applied to an already reduced offer price (larger packaging unit/bundle), the discount is deducted from the individual price. Cash redemption of discount codes is not possible, nor is any other offset or refund of the monetary value of a discount code. Discount codes issued to the customer are excluded from resale, and assignment is not allowed. The discount codes apply exclusively to the Motif22 online shop (https://motif22.de).
Validity
The validity period of discount codes is limited. Discount codes expire after the date stated on the discount code. An extension is excluded.
Return of Items
If you exercise your right of withdrawal or return the goods for other reasons, only the discounted purchase price will be refunded. There is no entitlement to a refund of the discount code or a new discount code.
Settlement with Multiple Items
If an order to which a discount code is applied consists of multiple items (shopping cart discount), Motif22 reserves the right to allocate the discounted amount to one or proportionally to several items.
Non-Fulfillment of an Order or Delivery
In case of non-fulfillment of the order or individual positions to which the discount code referred, there is no entitlement to a refund of the value of the discount code or a new discount code.
Liability
The above limitations and shortening of deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents. In these cases, we are always liable:
- for injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- for guaranteed promises, as agreed, or
- if the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on whose compliance the contractual partner can regularly rely (cardinal obligations), our liability in case of slight negligence is limited to the amount of damages that were foreseeable at the time of conclusion of the contract and typical for such breaches. In all other respects, claims for damages are excluded.
Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
